1. Acceptance of Terms

By downloading, installing, or using Rock Identifier - AI Scanner ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and Based Solutions LLC ("we," "us," or "our").

2. Description of Service

Rock Identifier - AI Scanner is an iOS application that uses artificial intelligence to help identify rocks and minerals from photographs. The App offers both free and premium subscription services:

Free Service: Allows users to upload or take one photo per day for rock identification analysis.

Premium Subscription: Provides unlimited rock identification requests and optional location-based enhancement for more accurate identification results.

3. Subscription Terms

Premium subscriptions are available on weekly and yearly billing cycles. Subscription features include:

• Unlimited rock identification requests
• Optional location-based identification enhancement

Billing Grace Period: We provide a 3-day billing grace period for subscription renewals. During this period, you will retain access to premium features while payment issues are resolved.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal in your App Store Account Settings.

4. Payment and Refunds

All payments are processed through Apple's App Store. Subscription prices are set in US dollars and may vary by region due to local tax requirements and currency conversion rates.

Refund Policy: Refund requests are handled by Apple through the App Store. To request a refund:

• Go to reportaproblem.apple.com
• Sign in with your Apple ID
• Find your Rock Identifier - AI Scanner purchase and select "Report a Problem"
• Follow the prompts to request your refund

We may also consider refund requests on a case-by-case basis. Contact us at help@liftalytics.app with your purchase details and reason for the refund request.

5. User Content and Images

When you upload images to Rock Identifier - AI Scanner:

• You retain ownership of your photos
• You grant us a temporary license to process your images for identification purposes
• Images are stored temporarily on our servers only for processing and are automatically deleted after analysis
• We do not use your images for any purpose other than providing identification services

6. Location Data (Premium Users)

Premium subscribers may optionally share location data to enhance identification accuracy. This feature:

• Is entirely optional and can be disabled at any time
• Uses location data only to provide geological context for better identification
• Does not store or track your location permanently
• Can be managed through the App's settings or your device's location permissions

7. Acceptable Use

You agree to use Rock Identifier - AI Scanner only for lawful purposes and in accordance with these Terms. You may not:

• Use the App for any illegal or unauthorized purpose
• Upload inappropriate, offensive, or copyrighted content
• Attempt to reverse engineer, hack, or circumvent the App's security measures
• Use automated systems to access the App or exceed usage limits
• Share your subscription access with others

8. Service Availability and Limitations

We strive to provide reliable service, but Rock Identifier - AI Scanner is provided "as is" without warranties. We do not guarantee:

• 100% accuracy of rock identifications
• Uninterrupted service availability
• Compatibility with all devices or iOS versions

Rock identifications are for educational and informational purposes only and should not be relied upon for professional geological analysis or safety decisions.

9. Intellectual Property

Rock Identifier - AI Scanner, including its design, features, and underlying technology, is owned by Based Solutions LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information when you use Rock Identifier - AI Scanner. The Privacy Policy is incorporated into these Terms by reference.

11. Service Access and Enforcement

While Rock Identifier - AI Scanner does not require user accounts, we reserve the right to restrict access to our identification services for violations of these Terms. This may include blocking requests from specific devices or IP addresses. Severe violations may be reported to Apple for potential app removal. You may stop using the App at any time by deleting it from your device.

12. Limitation of Liability

To the maximum extent permitted by law, Based Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of Rock Identifier - AI Scanner, including but not limited to loss of data, profits, or business opportunities.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Rock Identifier - AI Scanner will be resolved in the courts of Florida.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. Significant changes will be communicated through the App Store or within the App. Your continued use of Rock Identifier - AI Scanner after such changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
